Introduction
Please read these Terms of Service (“Terms”) carefully. They contain the legal terms and conditions that govern your use of services provided to you by Chios Aesthetic & Wellness, including information, text, images, graphics, data or other materials (“Content”) and products and services provided through chiosaesthetic.com and all elements, software, programs and code forming or incorporated in to chiosaesthetic.com (the “Service”). This Service is operated by Chios Aesthetic & Wellness LLC. (“Chios Aesthetic & Wellness”). Chios Aesthetic & Wellness is also referred to in these Terms as “we”, “our”, and “us”.
By using our website, you (“User” or “You,” or “Your” which collectively includes You and any other person or entity on whose behalf You may be acting) agree to the following terms and conditions at Section I, which contains provisions applicable to all users of our website (the “Site”). These terms are designed to protect your rights, ensure transparency, and maintain compliance with Florida regulations, including those outlined by the Agency for Health Care Administration (AHCA)
If you choose to purchase products from the Chios Aesthetic & Wellness Shop, you will be asked to check a box indicating that you have read, fully understand, and agree to be bound by the additional terms set forth in Section II of these Terms (“Additional Terms”).
Section I: General Terms
1. Scope of Services
• The Chios Aesthetic & Wellness offers professional medical aesthetic services, advanced skincare treatments, and cosmetic services in compliance with Florida laws and AHCA guidelines.
• Services include, but are not limited to, non-invasive skin treatments, chemical peels, microneedling, and other medical-grade cosmetic procedures performed under the scope of practice for licensed aestheticians.
• All treatments are provided with the highest standards of safety and efficacy. We do not offer medical diagnoses or treatments outside the aesthetic and cosmetic field.
2. Availability
This Service is provided by Chios Aesthetic & Wellness on an “AS IS” and “AS AVAILABLE” basis and Chios Aesthetic & Wellness reserves the right to modify, suspend or discontinue the Service, in its sole discretion, at any time and without notice. You agree that Chios Aesthetic & Wellness is and will not be liable to you for any modification, suspension or discontinuance of the Service.
3. Privacy
Chios Aesthetic & Wellness has a firm commitment to safeguarding your privacy. Please review our Privacy Policy. The terms of Chios Aesthetic & Wellness privacy policy are incorporated into, and form a part of, these Terms.
4. Payment and Refund Policies
• Payment: Full payment is required at the time of service. Accepted payment methods include credit cards, debit cards, and other electronic payment options.
• Refunds: Refunds are not provided for completed services. If you are dissatisfied with a service, please contact us immediately so we can address your concerns and find a resolution.
• Packages and Prepaid Services: Package treatments are non-refundable and non-transferable.
5. Client Responsibilities
• Health Information: Clients must provide accurate and complete health and medical history before receiving any treatment. This includes any allergies, medications, or pre-existing conditions.
• Follow-Up: Clients are responsible for following all aftercare instructions provided during and after their treatment.
• Ineligibility for Services: If you fail to disclose relevant health information or do not follow aftercare protocols, we reserve the right to refuse service or discontinue a treatment plan.
6. Disclaimer of Warranty and Limitation of Liability
Chios Aesthetic & Wellness makes no representations or warranties of any kind, express or implied as to the operation of the service, or products, provides, through the service. You expressly agree that your use of the service is at your sole risk. Chios Aesthetic & Wellness disclaims all warranties, express or implied, including without limitation, implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
All services are performed with your consent and at your discretion. The Chios Aesthetic & Wellness is not responsible for any adverse reactions resulting from undisclosed medical information, failure to follow aftercare instructions, or use of external products.
Chios Aesthetic & Wellness Shall not be liable for any damages of any kind arising from use of the service, including but no limited to direct, indirect, incidential, consequential, special, exemplary, or punitive damages, even if Chios Aesthetic & Wellness has been advised of the possibility of such damages.
The foregoing disclaimers, waivers and limitations shall apply notwhitstanding any failure of essential purpose of any limited remedy. Some jurisdictions do not allow the exclusion of or limitations on certain warranties or damages. Therefore, some of the above exclusions or limitations may not apply to you. In no event shall Chios Aesthetic & Wellness aggregate liability to you exceed the amounts paid by you to Chios Aesthetic & Wellness pursuant to this agreement.
7. Amendment of the Terms
We reserve the right to amend these Terms from time to time in our sole discretion. If you have registered as a member, we may notify you of any material changes to these Terms (and the effective date of such changes) by sending a notification on the Site. In addition, we will post the revised terms on the Site. If you continue to use the Service after the effective date of the revised Terms, you will be deemed to have accepted those changes. If you do not agree to the revised Terms, your sole remedy shall be to discontinue using the Service.
8. General
These Terms constitute the entire agreement between Chios Aesthetic & Wellness and you with respect to your use of the Service. Chios Aesthetic & Wellness’s failure to enforce any right or provision in these Terms shall not constitute a waiver of such right or provision. If a court should find that one or more provisions contained in these Terms is invalid, you agree that the remainder of the Terms shall be enforceable. Chios Aesthetic & Wellness shall have the right to assign its rights and/or delegate its obligations under these Terms, in whole or in part, to any person or business entity. You may not assign your rights or delegate your obligations under these Terms without the prior written consent of Chios Aesthetic & Wellness. These Terms shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts of the State of Florida.

Section II: Additional Terms
1. Personal information
Your submission of personal information through the store is governed by our Privacy Policy.
2. Registration
To register as a client of the Service for purchase products or services, you must be 18 years or lawfully permitted to enter into and form contracts under applicable law. In no event may minors submit Content to the Service. You agree that the information that you provide to us upon registration, at the time of purchase, and at all other times will be true, accurate, current and complete. You also agree that you will ensure that this information is kept accurate and up to date at all times. This is especially important with respect to your email address, since that is the primary way in which we will communicate with you about your account and your orders.
To register, fill out the information required and submit. Also, please be advised that some e-mail providers such as School/College e-mail accounts and some Free Services will block our address by policy. Please make sure to white list our e-mail to ensure delivery but we cannot guarantee delivery to some accounts due to policy out of our control. Please contact us directly for assistance registering.
3. Password
When you register as a client you will be asked to provide a password. You are responsible for safeguarding the password and you agree not to disclose your password to any third party. You agree that you shall be solely responsible for any activities or actions under your password, whether or not you have authorized such activities or actions. You shall immediately notify Chios Aesthetic & Wellness of any unauthorized use of your password.
4. Products or Services
All products or services are available exclusively online through the website. These products or services are subject to return or exchange only according to our Return Policy.
We have made every effort to display as accurately as possible the colors and images of our products that appear at the store.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. All descriptions of products or product pricing are subject to change at anytime without notice. We reserve the right to discontinue any product at any time.
We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.
Section III: Commercial Activities
Commercial activities mean the offering, solicitation or sale of goods or services by Chios Aesthetic & Wellness.
1. Product Purchases from the Chios Aesthetic & Wellness Shop
All payments are to be made in US dollars and prices are subject to change at any time. Postage and applicable sales taxes will be added to your order during the checkout process. Delivery dates are provided as an estimate only.
In general, Chios Aesthetic & Wellness accepts returns on defective products or incorrect orders within three (3) days after receipt of your order. Please contact by +1 (863)5854174, info@chiosaesthetic.com. If you do need to make a return, simply send a copy of your invoice or order acknowledgement. Returns can be for replacement or refund. Each return is credited in the same manner as payment. For example, if you paid for your order with a credit card, the credit will be applied to that card.
Except as expressly provided in this paragraph 1, any product purchased through the Chios Aesthetic & Wellness Shop is provided on an “as is” basis. Chios Aesthetic & Wellness sole obligation, and your sole and exclusive remedy, with respect to any defective product purchased through the Chios Aesthetic & Wellness Shop Shall be for Chios Aesthetic & Wellness to Provide a replacement or refund, as specified in the preceding paragraph
2. Dispute
If a dispute arises between You and Chios Aesthetic & Wellness, We will seek to resolve the dispute as quickly as commercially reasonable. Before resorting to legal proceedings, You must first contact Us directly and work with Us to resolve a dispute. If a dispute cannot be resolved by You and We, You will have the option to pursue a claim (a “Claim”) against Chios Aesthetic & Wellness in accordance with one of the options provided below or as We and You otherwise agree in writing.
This Agreement shall be governed in all respects by the laws of the State of Florida as they apply to agreements entered into and to be performed entirely within Florida between Florida residents, without regard to conflict of law provisions.
Option One – For any Claim (excluding claims for injunctive or other equitable relief) where the total amount of the award sought is less than $20,000, the party requesting relief may elect to handle the Claim in a cost effective manner through binding non-appearance-based arbitration. In the event a party elects arbitration, they shall initiate such arbitration through an established alternative dispute resolution (“ADR”) provider mutually agreed upon by the parties in the greater Orlando, Florida area. The ADR provider and the parties must comply with the following rules: a) the arbitration shall be conducted by telephone, online and/or be solely based on written submissions, the specific manner shall be chosen by the party initiating the arbitration; b) the arbitration shall not involve any personal appearance by the parties or witnesses unless otherwise mutually agreed by the parties; and c) the arbitrator’s decision shall be final and not appealable to any court or any other tribunal or arbitrator(s), and shall be entered and enforceable as a judgment in a court of competent jurisdiction in Florida.
Option Two – For any other Claim other than a Claim which qualifies and is opted for by a party under option one above, such Claim may be submitted by either You or Us for arbitration to the Orlando, Florida office of the American Arbitration Association. Such arbitration proceedings will be conducted in Orlando, Florida and will be heard by one arbitrator in accordance with the then current commercial arbitrations rules of the American Arbitration Association. Such arbitrator will be a lawyer of recognized standing and expertise in the area of commercial transactions.
Chios Aesthetic & Wellness retains the right to limit, suspend, or terminate Services for any user, prohibit access to the Site and take other actions deemed appropriate by Chios Aesthetic & Wellness to keep users off the Site if We conclude a user is in violation of the Terms or other agreement with Chios Aesthetic & Wellness.
You agree to comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding Your use of the Services and the Site and Your listing, sale, acquisition, advertising of offers to sell and purchase goods and services.
These Terms are effective , for current users, and upon use of the Site by a new user. We reserve the right to modify or terminate the Services for any reason, without notice, at any time. We reserve the right to alter or amend these Terms or other Site policies at any time. Any notices of termination or modification to the Services or the Terms will take effect when set forth on the Site. When using particular Services on the Site, You are subject to any unique posted policies or rules applicable to specific Services You use through the Site, which may be posted from time to time. All such policies or rules are hereby incorporated into this Agreement. This Agreement as supplemented by such other additional agreements for specific Services, sets forth the entire understanding and agreement between Us with respect to the subject matter hereof.
Any responsibilities or obligations of a User which accrue or arise during the term of this Agreement shall survive the termination of this Agreement until fully satisfied by You.
Payments made by credit card are made through the Stripe service or Paypal , so read Stripe’s privacy policies or Paypal’s privacy policies for more information, depending on the payment gateway you choose.
Section IV: Errors, inaccuracies and omissions
Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).
We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.
